They are governed by the following general conditions of sale, which we invite you to read entirely carefully. The products offered on the site are sold directly by Malambrì Alessandra. Corso Umberto 158, Taormina (ME – 98039), CF: MLMLSN72B60L042A, VAT: 03471520837. The site is the exclusive property of Malambrì Alessandra and is entirely managed by it.
These general conditions of sale exclusively regulate the offer, forwarding and acceptance of purchase orders for products on the site between users and the seller. Any information on the products offered for sale can be requested from our customer service, by e-mail to info@malambrishop.it
- How to conclude the contract with the seller
To conclude the purchase contract for one or more products on the site, you must fill out the order form in electronic format and send it to the seller, electronically, following the relevant instructions.
The order form sent to the seller through the site has the value of a contractual proposal and is subject to these general conditions of sale, which are an integral part of the order itself and that the buyer, by transmitting the order, must accept in full and without any reservation.
Before proceeding with the transmission of the order form, you will be provided with a summary of the order placed, the relative price (including all applicable taxes), the chosen payment method, the methods and costs of shipping and delivery.
You will also be asked to carefully read and accept these general conditions of sale, including the information on the right of withdrawal contained therein, as well as the privacy policy; to print and / or store a copy and finally to give consent to the processing of personal data provided.
In case of availability of the ordered products, the order form will be accepted by the seller by sending an order confirmation email to the e-mail address provided by you, which will contain a summary of the order placed and a description of the characteristics of the product ordered. The order form, the seller’s order confirmation and the general terms and conditions applicable to the relationship between the parties, will be stored electronically by the seller in its computer systems.
The contract is considered finalized when you receive the order confirmation from the seller by e-mail.
Otherwise, if the requested products are not available at the time of sending the order form, the seller will promptly communicate any unavailability and the timing for any restocking. You will then be asked to confirm, always electronically, the acceptance of the timing for the replenishment of the requested product, as communicated by the seller. In case of your confirmation, the seller will send order confirmation e-mail, as complete above.
The seller, upon notice, may in any case not process purchase orders that are incomplete and / or incorrect, or in case of unavailability of products for which replenishment is not foreseen.
- Pricing and Availability
All sales prices of the products displayed on the site are indicated in €uro and include VAT. The offer of the products presented on the site is subject to their actual availability;
In case of unavailability of one or more products, the seller will communicate any timing for replenishment and you can accept or not the new timing and conditions of sale. Likewise, if due to sudden changes, the price of one or more products indicated on the site should be different from the correct sale price, you will be asked to confirm the desire to purchase the product at the correct price; otherwise the order cannot be accepted.
- Payments
The payment of the price of the products and the relative shipping and delivery costs can be made by choosing one of the following methods when filling out the order form.
The Customer may make payments by:
- Credit cards (Visa, Visa Electron, Mastercard)
- PayPal System
- SumUp System
The security of payments made by credit card is guaranteed and managed by the two payment systems listed above, namely Stripe and PayPal. Online credit card transactions are made directly on the Bank’s website and the buyer’s credit card information is typed directly on the website of the bank that manages the transaction (with very high security systems); Since there is no data transmission, there is no possibility that this data will be intercepted. No computer archive of Malambrì Alessandra contains, or stores, such data.
- Shipping and delivery of products
The seller undertakes to deliver the products to the address communicated by the customer in the purchase order, by express courier
The shipment will be made about one working day after the order and will be delivered to the customer from 2/3 working days in ITALY.
The delivery terms are purely indicative and have no contractual value.
The seller cannot be held responsible for errors in delivery due to your inaccuracies or incompleteness in the compilation of the purchase order.
Shipping costs are charged to the customer, they are calculated at the time of placing the order. For orders of a total amount of € 50.00 will be charged € 6.90 for orders of a total amount exceeding € 50.00 shipping is free.
- Right of Withdrawal
The right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:
The right of withdrawal does not apply to the supply of food that, by its nature, cannot be returned or is likely to deteriorate or expire rapidly.
By confirming the order, the customer declares to accept this clause.
- Warranties on products sold and limitations of liability
The essential characteristics of the products are presented on the site within each product sheet.
According to the law, if the goods received are different from the one requested, ie present defects or malfunctions or in any case are not suitable for the use for which goods of the same type are intended, does not correspond to the seller’s description or does not present the quality of a good of the same type, you will have the right to restore without charge the conformity of the goods by replacement, or, if this is not possible, the termination of the contract.
The seller will not be liable in case of non-substantial differences between the goods purchased and their illustrative images and text descriptions published on our site and is also not responsible in case of improper use of the product.
In case of ascertained non-conformity of the product, the seller will refund the buyer the price of the product including the shipping costs incurred for the return of the non-compliant product.
The refund will be made by the seller by bank transfer or PayPal to the bank details provided by the buyer.
- Alternative dispute resolution (adr) / online dispute resolution (odr)
EU Regulation no. 524/2013 and Legislative Decree. n. Legislative Decree 130/2015 introduced legislation aimed at facilitating the out-of-court settlement of disputes between consumers and traders relating to a product or service purchased online. To this end, a European Online Dispute Resolution platform (so-called ODR platform) has been created, which can be consulted at http://ec.europa.eu/consumers/odr/. Through the ODR platform, the consumer can send a complaint relating to a contract concluded online with Malambrì Alessandra and thus activate the online dispute resolution procedure. These Conditions are subject to Italian law. For all orders from subjects not qualified as “consumers”, all disputes relating to the interpretation and / or execution of this contract, will be the exclusive competence of the Court of Catania.
